Terms of Service

1. Acceptance
By using Opensar, you agree to these Terms.

2. Purpose of the App
The app is designed for voluntary collaboration in drone-assisted search activities.
It is not:
A certified emergency service
A replacement for official rescue authorities
A regulated air traffic coordination service

3. User Responsibilities
Users agree:
To comply with applicable drone laws in their country
Not to misuse location data
Not to harass, stalk, or track individuals outside search purposes
To verify airspace restrictions and operational conditions using official sources, and
ensuring safe operation of their equipment.

To only upload lawful images
Users are solely responsible for compliance with aviation regulations, including those set by:
European Union Aviation Safety Agency (EASA)
National aviation authorities

4. Prohibited Uses
You may not:
Use the app for surveillance
Use the app for law enforcement without authorization
Reverse engineer the system
Attempt to identify users beyond provided nicknames

5. Liability Disclaimer
The service is provided “as is.”
We are not liable for:
Drone accidents
Search failures
Misidentification of remote IDs
User misuse of data

While we make reasonable efforts to ensure functionality and accuracy, we do not guarantee that:

the app will be uninterrupted or error-free,
the information provided will be accurate, complete, or up to date, or
the app will meet specific operational or regulatory requirements.


6. Account Termination
We may suspend or terminate accounts for:
Abuse
Illegal use
Violation of aviation or privacy laws
Any attempts to use the service it is not intended for

7. Governing Law
These terms are governed by the laws of the Netherlands.

Limitation of Liability

To the fullest extent permitted by applicable law, EU Remote Consulting shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, loss of data, business interruption, or reputational harm arising out of or in connection with the use of, or inability to use, the app.

Nothing in these Terms excludes or limits liability where such exclusion is not permitted under applicable law, including liability for:

death or personal injury caused by negligence,
fraud or fraudulent misrepresentation, or
any other liability that cannot be excluded under EU or national law.

Where liability cannot be excluded, our total liability shall be limited to the amount paid by the user (if any) for use of the app in the preceding 12 months.
